Medical Malpractice Rate Filings In compliance with the Medical Malpractice Liability Hearing Rules and Rate Filing Requirements, DISB is providing consumers with a list of rate filings that have been filed with the agency.  The purpose of the list is to safeguard the public interest by allowing reasonable inspection and analysis of medical malpractice liability company rate plans and premium rates. Rate filings must be submitted at least annually.  If no change is anticipated after one year, a filing may indicate the existing rate filing will continue in effect.  Once a rate filing meet Department standards, the Commissioner shall make the rate filing public, via posting on the Department’s website and any other means reasonably designed to provide meaningful and timely notice, of any rate filing by a medical malpractice insurer.  These filings will be identified as being “Filed” with the Department.   Filed rates shall be deemed approved 60 days after posting on the Department’s web site unless the proposed rate change increase exceeds ten percent (10 percent). If the proposed rate increase exceeds ten percent (10 percent), the Commissioner shall hold a hearing on the proposed change and shall issue an order approving, denying or modifying the proposed change within 90 days after public notice of the proposed change.
